Introducere. Vă rugăm să citiți acest document cu atenție. Acest document (denumit în continuare „Prezentul document”, sau „Termeni și Condiții”), împreună cu documentele menționate în el, reprezintă condițiile utilizării site-ului www.faceclubbucharest.com (denumit în continuare „site-ul”) și rezervărilor online la evenimentele noastre. Prin navigarea pe site-ul nostru, prin înscrierea ca membru, prin rezervarea unei mese de acord cu Termenii și Condițiile descrise mai jos. Acest document reprezintă o convenție legală – un contract între dumneavoastră și noi. Vă rugăm să citiți și Politica noastră de confidențialitate și Politica privind utilizarea modulelor cookie, înainte de a naviga pe site sau a plasa o comandă. Dacă nu sunteți de acord cu acești Termeni sau cu Politicile indicate mai sus, vă rugăm să nu utilizați site-ul sau să nu faceți rezervări pe site-ul nostru.

2. PREZENTUL CONTRACT. OBLIGATIVITATE. CONTACT

Caracter obligatoriu. Înțelegeți că atât prezentul document, cât și toate politicile la care acesta face referire (i.e. Politică de confidențialitate, Politică privind utilizarea modulelor cookie) au caracter obligatoriu față de dvs. Prin navigarea pe site-ul nostru, prin înscrierea ca membru sau prin rezervarea unei mese, vă luați angajamentul de a respecta prezentul document și politicile indicate.

Modificări și actualizări. Ne rezervăm dreptul de a modifica oricând și fără notificare prealabilă acești Termeni. Rezervării dvs. i se vor aplica termenii care sunt în vigoare la momentul plasării rezervării. Accesând site-ul nostru veți găsi cea mai recentă versiune a Termenilor.

Nu putem garanta faptul că orice evenimente care au fost incluse la un moment dat în activitatea noastră vor fi disponibile în orice moment. Ne rezervăm dreptul de a înceta în orice moment organizarea unui eveniment.

4. DATELE DVS. CU CARACTER PERSONAL

 

Site-ul prelucrează date cu caracter personal furnizate de dvs sau colectate din alte surse așa cum am descris pe larg în Politica de confidențialitate. Ne-am luat angajamentul să respectăm legislația națională și europenă privind protecția datelor cu caracter personal și libera circulație a acestor date.

Prin vizitarea și/sau utilizarea site-ului, plasarea unei rezervări, prin participarea la evenimentele, prin vizitarea cluburilor și locațiilor noastre sau prin interacțiunea cu noi prin orice metodă și/sau orice mijloc de comunicare la distanță, sunteți de acord cu prelucrarea datelor dvs. cu caracter personal astfel cum am descris în Politica de confidențialitate.

Declarați, totodată, că toate datele personale și informațiile transmise către noi sunt actualizate, exacte. În măsura în care datele nu vă aparțin, declarați că ați obținut acordul scris și prealabil al persoanei vizate ale cărei date le transmiteți către noi sau că transmiteți datele în baza altui temei legal conform Regulamentului (EU) 679/2016.

5. ELIGIBILITATE

Pentru a vă putea înscrie la membru sau putea plasa în mod legal o rezervare pe site-ul nostru trebuie (1) să aveți peste 18 și/sau capacitate deplină de exercițiu, (2) să fiți de acord cu Termenii și cu Politicile de protecție a datelor cu caracter personal; și (3) să ne furnizați informații de contact reale, complete și actualizate.

6. REGULI PRIVIND UTILIZAREA SITE-ULUI 

Reguli. Prin accesarea, vizitarea, plasarea unei rezervări sau desfășurarea oricărei alte activități pe site-ul nostru, promiteți să respectați următoarele reguli:

• Veți folosi acest site exclusiv pentru efectuarea rezervărilor legitime sau pentru informare;
• Nu veți efectua nicio rezervare falsă sau frauduloasă, în caz contrar ne rezervăm dreptul de a anula rezervarea și informa autoritățile competente sau a ne adresa justiției pentru recuperarea oricăror prejudicii cauzate;
• Veți furniza informații reale, exacte, complete și actualizate;
• Veți respecta drepturile de proprietate intelectuală cu privire la orice element regăsit pe acest site.
• Nu veți desfășura niciun fel de acțiune care ar putea aduce orice fel de prejudiciu site-ului nostru, în caz contrar ne rezervăm dreptul de a ne adresa justiției pentru recuperarea oricăror prejudicii cauzate.

Consecințe. Ne rezervăm dreptul de a bloca accesul oricărui utilizator care încalcă regulile de mai sus, de a anula rezervările, de a sesiza autoritățile competente pentru tragerea la răspundere administrativă/penală a oricăror fapte antisociale și de a ne adresa justiției pentru recuperarea în integralitate a oricăror prejudiciilor cauzate, prezente sau viitoare, inclusiv beneficiile nerealizate și cheltuielile de judecată (inclusiv onorariile avocaților).

7. DECIZIA NE APARȚINE

Decizia ne aparține. Ne rezervăm dreptul de ne selecta clientela, în mod unilateral și fără a preciza motivul. Nu vom avea nicio răspundere față de dvs. în situația în care refuzăm să dăm curs unei rezervări sau nu vă permitem accesul în locațiile noastre.

8. FORȚA MAJORĂ ȘI CAZUL FORTUIT

Nu vom fi trași la răspundere pentru niciun fel de întârzieri sau nereușite în îndeplinirea serviciilor noastre, dacă intervine un caz de forță majoră sau un caz fortuit. Forța majoră include, dar nu se limitează la schimbări în legi sau reglementări, embargouri, războaie, acte teroriste, revolte, incendii, cutremure, accidente nucleare, inundații, greve, condiții meteorologice și acte ale hackerilor sau furnizorilor de servicii de internet.

9. PROPRIETATE INTELECTUALĂ

Întregul conținut al site-ului este proprietatea intelectuală a HIGH ENTERTAINMENT CONCEPT SRL. Utilizatorii site-ului nu au dreptul de a descărca, modifica partial sau integral site-ul,  reproduce partial sau integral site-ul, copia, distribui, vinde sau exploata site-ul în orice altă manieră contrară intereselor Societății HIGH ENTERTAINMENT CONCEPT SRL indiferent dacă există sau nu un scop comercial.

Orice conținut (incluzând, dar fără a se limita la baze de date, elemente de grafică, mărci, conținut juridic) sunt sunt proprietatea intelectuală a Societății HIGH ENTERTAINMENT CONCEPT SRL. Întregul site este protejat de Legea 8/1996 privind drepturile de autor și drepturile conexe, iar pentru orice încălcare a proprietății intelectuale, ne rezervăm dreptul de a sesiza instanțele de judecată competente pentru recuperarea integrală a prejudiciului, precum și de a depune o plângere penală la organele judiciare pentru tragerea la răspundere penală a făptuitorului.

By navigating our website, by registering as a member, by reserving a table you agree with the Terms and conditions described below. This document represents a legal convention – a contract between you and us. Please also read our Privacy Policy and the Cookies use policy, before navigating the website or placing an order. • By visiting and/or using the website, by placing a booking, by participating in events, by visiting our clubs and locations or by interacting with us through any other way and/or any means of distance communication, you agree with personal data being processed, as we described in the Privacy policy. 

• Also, you state that all personal data and information sent to us are up-to-date and accurate. In case the data do not belong to you, you state that you were granted the written and prior consent of the data subject whose data you are sending to us or that you are doing this under another legal basis according to the Regulation (EU) 679/2016.

• ELIGIBILITY. CLOTHES. CONDUCT RULES

• In order to register as a member or to legally place a booking on our website, you must (1) be at least 18 years of age and/or have full capacity, (2) agree with the Terms and Personal data protection policies, and (3) provide us with real, complete and up-to-date contact information. 

• Events for minors. We do not organize events for persons aged under 18 years. For more information, you can contact us at any time by sending a message at office@faceclubbucharest.com.

•   The persons aged under 18 are not allowed to enter our locations and clubs.

•   Clients must wear elegant clothes (dress code) inside our locations. Sport clothes, shoes or accessories are not allowed inside our locations and clubs. 

•   In order to benefit from a booking, clients must arrive between 23:00 and 00:30, otherwise we reserve the right to cancel the booking without any prior formality and without informing the client. 

•   The location does not take any responsibility whatsoever for lost or stolen belongings. In case of losses, stealing or other antisocial or criminal actions, we do not have the obligation to hand over the images captured on the surveillance cameras, except when this is requested by the dully authorised bodies. 

• RULES ON WEBSITE USE

• Rules. By accessing, visiting, placing a booking or carrying out any other activities on our website, you promise to comply with the following rules:

• You will use this website only for making legitimate bookings or for information;

• You will not make any fake or fraudulent booking, otherwise we reserve the right to cancel the booking and inform the competent authorities or we will address justice in order to recover any caused damages;

• You will provide real, correct, complete and up-to-date information;

• You will respect the intellectual property rights regarding any element found on this website. 

• You will not carry out any action which may bring any damage to our website, otherwise we reserve the right to access justice in order to recover any caused damages. 

• Consequences. We reserve the right to block the access to any user who fails to comply with the above-mentioned rules, to cancel the bookings, to lodge a complaint with the competent authorities for engaging the administrative/criminal responsibility for any antisocial actions and to address justice for recovering the totality of any caused damages, present or future, including the loss of earnings and costs of the proceedings (including the lawyers’ fees).

• THE DECISION IS OURS
• The decision is ours. We reserve the right to unilaterally select our clients without providing the reasons for our choices. We will not have any responsibility towards you in case we refuse to accept a booking or we do not allow you to enter our locations. 

 

• FORCE MAJEURE AND UNFORSEEABLE CIRCUMSTANCES

 

8.1. We will not be responsible for any delays or failures to provide our services in case of force majeure or unforeseeable circumstances. Force majeure includes, but it is not limited to, changes in laws or regulations, embargoes, wars, terrorist acts, riots, fires, earthquakes, nuclear incidents, floods, strikes, weather conditions and hackers’ or internet services providers’ actions. 

 

• INTELLECTUAL PROPERTY 

•    The whole content of the website is the intellectual property of HIGH ENTERTAINMENT CONCEPT SRL. The website’s users do not have the right to download, partially or fully modify the website, partially or fully reproduce the website, to copy, distribute, sell or exploit the website in any way contrary to the interests of HIGH ENTERTAINMENT CONCEPT SRL company, no matter if there is a commercial purpose or not.

• Any content (including, but not limited to the data bases, graphic elements, trademarks, legal content) are the intellectual property of HIGH ENTERTAINMENT CONCEPT SRL. The entire website is protected by Law no. 8/1996 on copyright and related rights, and for any infringement of intellectual property, we reserve the right to address the competent courts for fully recovering our damages, as well as to lodge a complaint with the judicial bodies to held criminally responsible the offender. 

•  APPLICABLE LEGISLATION

• This document, as well as any use of this website, shall be governed by the Romanian law. Any dispute between the parties will be referred to the Romanian courts.
